1. What ParMutuel is
ParMutuel (the “Service”) is software operated by Elevate SaaS, Inc. (“we”) that lets a golf club or tournament organizer (an “Organization”) run pari-mutuel style pools denominated in credits for its own members and guests (“Members”). The Service records credits, wagers, results and payouts. It does not accept, hold, transmit or pay out money.
2. Credits and money
Credits are units of account issued to Members by the Organization's staff and redeemed by the Organization's staff. Any value attached to credits, and any funding or payout, is a matter solely between the Organization and its Members and happens outside the Service. We are not a party to any wager and have no interest in the outcome of any pool. Our fees are fixed software fees and are never calculated as a share of any pool, handle or takeout.
3. Organization responsibilities
The Organization is solely responsible for determining whether, and how, it may lawfully run games using the Service in its jurisdiction, including compliance with any social-gambling, private-club or charitable-gaming exemptions and any age requirements; for publishing house rules to its Members; for the accuracy of results it confirms; and for the conduct of its staff. The Organization will not use the Service to run games for the public or for persons under the age it has set (never under 18).
4. Member responsibilities
Members must be of the age required by their Organization (at least 18), must be eligible under their Organization's rules, and agree that the Organization — not ParMutuel — is responsible for crediting and paying them. Members may request a self-exclusion from their Organization at any time.
5. Accounts and communications
Sign-in is by one-time code to a mobile number or email address. You are responsible for keeping your device secure. Transactional messages (tickets, credits, results) are part of the record of your wagers and will be sent by email even if you opt out of texts. See the SMS terms for texting.
6. Records and corrections
The Service keeps an append-only ledger of credits. Organizations may correct results and reverse settlements; reversals are recorded, never deleted, and are visible to affected Members. The ledger as maintained by the Service is the record of credits between an Organization and its Members for the purposes of the Service, but the Organization remains responsible for any payment.
7. Fees
Organizations pay the fees shown on the pricing page or in their order form. Per-tournament plans are invoiced per tournament; Season Pass is an annual subscription that renews unless cancelled before renewal. Fees are exclusive of taxes.
8. Acceptable use; suspension
We may suspend an Organization or Member that uses the Service for public gambling, for persons under age, in breach of applicable law, or in a way that harms the Service or other users. We may also suspend to protect the integrity of the ledger.
9. Disclaimers and limitation of liability
The Service is provided “as is”. We make no warranty as to the legality of any game. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, for any amounts wagered, won or owed between an Organization and its Members, or for more than the fees paid by the Organization in the twelve months before the claim.
